This website is operated by Van Colden Art.  Access to and use of this site, including products and services are subject to the following Terms and Conditions.  Throughout the site, the terms “we”, “us”, “my”, “I” and “our” refer to Van Colden Art.

By using any part of this website, and/or purchasing something from this site, you engage in our “Service” and you agree to be bound to these Terms and Conditions. These Terms and Conditions apply to all users of this site.   We reserve the right to update, change, or replace The Terms and Conditions by posting updates or changes to our website.  It is your responsibility to check his page periodically for applicable changes.  Continued use of this website following post changes, constitutes acceptance of those changes.

Van Colden Art will not be liable if this Website is unavailable at any time or for any period.

1.     By using our Website, you represent that you are the age of majority.

2.     Prices for our products are subject to change without notice and we reserve the right to modify or discontinue product/service without notice at any time. We are not liable for any modification, price change, or discontinued products.

3.     You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws, including but not limited to copyright laws.

4.     We reserve the right to refuse service to anyone for any reason at any time.

5.     You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the service, content, artwork, without express written permission by us.

6.     If information made on this site is not accurate, complete, or current, we are not responsible, as it is provided for general information only. Reliance on the material on this site is at your own risk.  Historical information is provided for your reference only. We reserve the right to modify the contents of the site at any time however, we hold no obligation to update any information on our website.

7.     There may be typographical errors, inaccuracies, or omissions that may relate to our products, descriptions, pricing, promotions, offers, product shipping charges, and availability.  Van Colden Art reserves the right to correct errors and inaccuracies, to update, or change information on our website at any time. At any time, Van Colden Art reserves the right, without prior notice, to cancel orders if the information regarding the product, on our website or any related website is inaccurate, including after you have submitted your order.

8.     We have taken extra care to ensure that the colours and images of our products are displayed as accurately as possible.  We cannot guarantee that your computer monitor’s display of any colour will be accurate and there may be variations in shade and colour.  Thereby we do not warrant that the colour quality of any products or other material purchased will meet your expectations or that any errors in service will be corrected.

9.     We reserve the right to limit sales or quantities of our products.

10.  Descriptions or pricing of products are subject to change at any time without notice, at our sole discretion.

11.  We reserve the right to discontinue any products and any time without notice, at our sole discretion.

12.  Currency is in Canadian dollars.

13.  The price of original artwork does not include duties, taxes, shipping, and handling. Taxes will be charged at checkout. Duties, and Shipping and Handling, will be charged as applicable depending on the physical location of the original pieces and the shipping address provided by the buyer.  The buyer agrees to pay and be liable for any duties and taxes that might be applicable on the purchase and charges shall be payable in addition to the price of the artwork.

14.  Van Colden Art is not liable for any charges that may be levied at the destination.

15.  If the original artwork purchased directly from Van Colden Art, does not satisfy the buyer, you have 15 business days from receipt of the artwork, to return it in its original package for a refund.  All original pieces fulfilled by galleries will follow the Return Policies and Terms and Conditions of the Gallery that holds the piece. Shipping costs will not be refunded.

16.  To be eligible for a return, the item must be in the same condition that you received it and in its original packaging.

17.  Receipt of proof of purchase is required to complete any returns.

18.  Refunds will not be issued for items not in their original condition, damaged items, or for items missing parts not due to our error, or for items returned more that 30 days after delivery.

19.  Van Colden Art reserves the right to refuse any order you placed and/or limit or cancel quantities purchased by one person, per household, or per order. If changes are made to an order, or if an order is cancelled, we may attempt to notify you by contacting the e-mail provided at the time of order. Van Colden Art reserves the right to limit or prohibit orders, that in our judgement, appear to be placed by dealer, resellers, or distributors.

20.  The buyer agrees to provide current and accurate account information including e-mail address, credit card numbers, and expiration dates so that we can complete your transactions and contact you if required.

21.  Certain content and products available via Van Colden Art may include third-parties and may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of third-party sites. Van Colden Art is not liable or responsible for any third-party materials, products, websites, or service. Van Colden Art is not liable for transactions made in connection with third-party websites.  It is the buyer’s responsibility to  carefully review the third-party’s policies, practices, and terms and conditions. Complaints and concerns regarding third-party products should be directed to the third party.

22.  Van Colden Art will not be responsible for any delays in delivery, no matter how they are caused.

23.  Personal information submitted through our online store is governed by our Privacy Policy.

24.  Van Colden Art does not guarantee that your use of our service will be uninterrupted, timely, secure or error-free. We may remove our products/service for indefinite periods of time without notice to you. The products/services delivered to you are provided “as is” and “as available” without conditions or warranties either expressed or implied.

25.  If you fail, or we suspect that you have failed, to comply with any terms in our Terms and Conditions, we reserve the right to terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination.
